Welcome to Mapiown. These Terms of Service (“Terms”) govern your access to and use of the Mapiown platform, including our career assessment tools, trait taxonomy, career cluster classifications, and mentor and counselor services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. User Responsibilities

By using the Platform, you agree to the following responsibilities:

    • Provide accurate and honest responses to all assessments and career evaluations. The quality and relevance of recommendations depend entirely on truthful input, and you acknowledge that dishonest or misleading responses may result in inaccurate career guidance. Mapiown is not responsible for outcomes resulting from false information you provide.
    • Not screenshot, record, or share assessment results, counselor conversations, or mentor feedback without explicit permission from all parties involved.
    • Not use automated tools, bots, or scripts to extract, download, or reproduce any assessment data, career clusters, trait taxonomy, or Platform content without explicit written permission.
    • Not engage mentors or counselors for services outside the Platform; professional relationships facilitated through Mapiown must remain within the Platform.
    • Maintain only one active account and not create duplicate accounts to access features, bypass payment, or circumvent restrictions.
    • Not misrepresent your identity, qualifications, credentials, or professional status, including impersonating a mentor, counselor, or other professional.
    • Not collect, aggregate, or use personal information shared by other users for purposes outside the Platform.
    • Be solely responsible for protecting your login credentials and not share account access with others.
    • Comply with all applicable laws and regulations in your jurisdiction when using the Platform, including employment laws and data protection regulations.
    • Not use the Platform in ways that disrupt it, including overloading servers, creating spam content, or harassing mentors, counselors, or other users.
    • Use the Platform only for lawful career guidance and personal development purposes, not for commercial exploitation or competitive intelligence gathering.

Violations of these responsibilities may result in account suspension, termination, or legal action, and Mapiown reserves the right to investigate suspicious activity. Providing false information to counselors or mentors may result in immediate account termination without refund.

2. Acceptable Use Policy

In addition to the responsibilities above, you agree that you will not:

    • Access, view, or attempt to access any other user’s personal data, assessment responses, or mentor conversations. You may only access your own assessment data and career results. Unauthorized access will result in immediate account termination and potential legal action.
    • Use bots, scripts, or automated tools to scrape or extract user data from the Platform.
    • Reverse engineer, decompile, or attempt to discover the source code or proprietary algorithms underlying Mapiown’s assessments or career cluster methodology.
    • Use the Platform for spam, phishing, fraud, or any illegal activity.
    • Interfere with Platform security or attempt unauthorized access to systems or accounts.
    • Resell, redistribute, or commercialize the Platform or provide access to unauthorized third parties.
    • Use Platform output, assessment methodologies, or the trait taxonomy to train competing AI models or to build derivative career assessment tools.
    • Publicly disclose Mapiown’s proprietary assessment methodologies or trait taxonomy.

3. Limitation of Liability

Mapiown provides career guidance and assessments for informational purposes only and does not guarantee employment outcomes, salary levels, or career success. You rely on assessments at your own risk.

Mapiown is not responsible for the quality, accuracy, or professionalism of advice given by mentors or counselors. Mentors and counselors are independent professionals, and, unless otherwise stated, independent contractors rather than employees of Mapiown.

To the maximum extent permitted by law, Mapiown’s total liability arising out of or relating to these Terms or the Platform shall not exceed the total amount you paid to Mapiown in the twelve (12) months preceding the claim.

Mapiown shall not be liable for:

    • Indirect, incidental, consequential, or punitive damages, including lost income, lost opportunities, emotional distress, or reputational harm.
    • Unauthorized access to your account or data resulting from your own negligence, including sharing your credentials.
    • Content created or shared by users, mentors, or counselors through the Platform.
    • Events beyond Mapiown’s reasonable control, including natural disasters, government actions, or other force majeure events.
    • Third-party integrations, services, or subprocessors, except where Mapiown was directly negligent in selecting or supervising them.
    • Decisions you make regarding your career, finances, education, or other life changes based on assessment results or Platform guidance.
    • Downtime, technical errors, bugs, or data loss arising from system failures, service interruptions, or maintenance.
    • Discontinuation or interruption of a mentor or counselor relationship.

These limitations apply to Mapiown and its officers, employees, mentors, counselors, and affiliates. Some jurisdictions do not allow certain liability exclusions, so some of the above limitations may not apply to you, and your statutory rights are not affected.

4. Dispute Resolution

Mapiown and users agree to resolve disputes through the following tiered process:

4.1 Support Resolution

You must first submit any complaint or dispute to Mapiown support. Mapiown will respond and attempt to resolve the matter within thirty (30) days.

4.2 Mediation

If a dispute is not resolved through support within thirty (30) days, either party may request mediation before a mutually agreed neutral mediator (which may include a qualified lawyer, retired judge, or professional mediation service). No fixed timeline applies to the mediation stage.

4.3 Binding Arbitration

If mediation does not resolve the dispute, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 of India, before a single arbitrator. The seat and venue of arbitration shall be New Delhi, India, and proceedings shall be conducted in English. The arbitrator’s decision shall be final and binding, with limited grounds for appeal as provided under Indian law.

4.4 General Provisions

    • All proceedings, documentation, and communications related to dispute resolution shall be conducted in English.
    • All information shared during mediation and arbitration is confidential and may not be disclosed publicly or used in other proceedings.
    • Each party bears its own costs and legal fees unless the arbitrator determines otherwise.
    • Both parties agree to attempt good-faith resolution through support before initiating mediation or arbitration, and not to pursue the same dispute in multiple forums simultaneously.
    • Notwithstanding the foregoing, either party may seek interim or injunctive relief from a court of competent jurisdiction to prevent irreparable harm, including for intellectual property violations or breaches of confidentiality, while dispute resolution proceedings are ongoing.

5. Intellectual Property

All career clusters, trait taxonomy, assessment methodologies, Platform design, software, and content are owned by Mapiown and protected by applicable copyright, trademark, and intellectual property laws.

Subject to your compliance with these Terms, Mapiown grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal career guidance purposes only. This license does not permit commercial use, resale, or redistribution.

    • You may not modify, reverse engineer, decompile, or create derivative works from Mapiown’s assessments, career clusters, or trait taxonomy.
    • You retain ownership of your personal data and assessment responses, but grant Mapiown a license to use such data for Platform improvement, analytics, and research, including in anonymized or aggregated form.
    • Any feedback, suggestions, or testimonials you provide become Mapiown’s property and may be used without compensation to you.
    • Mapiown’s trademarks, logos, and brand names may not be used without prior written permission.
    • You may not publicly disclose or reverse engineer Mapiown’s proprietary assessment methodologies or trait taxonomy.
    • You may not use Platform output, results, or content to train competing AI models or to build competing career assessment tools.
    • You are responsible for ensuring your own submissions do not infringe on any third party’s intellectual property; Mapiown is not liable for user-generated content that does so.
    • Mapiown reserves the right to pursue legal action, including immediate removal of content and account termination without refund, for any infringement of its intellectual property rights.

These intellectual property provisions survive termination of your account or discontinuation of the Platform.

6. Indemnification

You agree to indemnify, defend, and hold harmless Mapiown, its owners, employees, and contractors from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys’ fees and court costs) arising from:

    • Your use of the Platform or violation of these Terms;
    • Infringement of intellectual property rights;
    • False information you provided, including for use in employment, education, or other decisions;
    • Harassment, misconduct, or defamation involving other users, mentors, or counselors;
    • Breach of confidentiality obligations, including unauthorized sharing of assessment results or mentor/counselor conversations;
    • Unauthorized access to, or misuse of, other users’ data;
    • Damage to the Platform caused by your actions, including hacking or introduction of malware;
    • Any violation of applicable laws or regulations arising from your use of the Platform.

Mapiown reserves the right, at its own expense, to assume exclusive control of the defense of any matter otherwise subject to indemnification by you. This indemnification obligation survives termination of your account and does not apply to the extent a claim arises from Mapiown’s gross negligence or willful misconduct.

7. Termination and Suspension

Mapiown may suspend your access immediately or after notice for violations of these Terms, including providing false information, harassment, intellectual property infringement, non-payment, or suspicious activity.

Mapiown may terminate your account permanently for repeated violations, fraud, illegal activity, or conduct that harms the Platform or other users, including without notice where the violation poses an immediate risk. Mapiown may reactivate a suspended account at its discretion once a violation is resolved.

    • Upon suspension or termination, you immediately lose access to the Platform, including assessment results and mentor/counselor relationships. Mapiown is not responsible for notifying mentors or counselors of your termination.
    • Mapiown retains user data following termination for legal, regulatory, security, and dispute-resolution purposes for as long as required or permitted by applicable law.
    • Terminated users are not entitled to refunds of prepaid fees; refunds for non-breach terminations may be considered at Mapiown’s sole discretion.
    • Users terminated for serious violations may not create new accounts or use the Platform under a different identity; Mapiown may act across multiple accounts to enforce such bans.
    • Termination does not release you from payment obligations, indemnification responsibilities, or confidentiality and intellectual property obligations, all of which survive termination.
    • Mapiown is not liable for any losses, data loss, or service interruption resulting from suspension or termination, and may repurpose anonymized data after termination for Platform improvement and analytics.

8. Confidentiality of Mentor and Counselor Relationships

All conversations, advice, and information shared between users and mentors or counselors are confidential and must not be disclosed to third parties without explicit written consent from all parties involved.

    • Mentors and counselors agree to maintain professional confidentiality standards and comply with applicable privacy laws, except where disclosure is required by law, court order, or to prevent harm to the user or others.
    • Users agree not to record, screenshot, or share mentor or counselor conversations publicly without written consent from all parties.
    • Confidential information may not be used for purposes outside the mentoring or counseling relationship, including commercial use or public disclosure.
    • Mapiown is not liable for breaches of confidentiality caused by mentor or counselor misconduct occurring outside the Platform, unless Mapiown was directly negligent in vetting or supervising them. Mapiown reserves the right to suspend or terminate mentors and counselors who violate confidentiality.

Confidentiality obligations under this section survive the end of the mentoring or counseling relationship and termination of your account.

9. Third-Party Content and Subprocessors

The Platform may contain links to third-party websites or services. Mapiown does not endorse and is not responsible for third-party content, and you access such sites or services at your own risk. You agree not to hold Mapiown liable for damages or losses arising from third-party links, content, or services accessed through the Platform.

Mapiown uses third-party service providers, including cloud hosting providers and payment processors, to operate the Platform (“Subprocessors”). Mapiown remains responsible for ensuring these Subprocessors comply with applicable data protection laws. An up-to-date list of Subprocessors is available on Mapiown’s website; you are responsible for reviewing it periodically, and continued use of the Platform after an update constitutes acceptance of any changes.

10. Data Protection and User Rights

Subject to applicable law, including the Digital Personal Data Protection Act (India) and, where applicable, the General Data Protection Regulation (GDPR), you have the right to access, rectify, and request deletion of your personal data, and to request your data in a structured, portable format. Mapiown will respond to such requests within thirty (30) days, except where Mapiown is required or permitted to retain data for legal, regulatory, or dispute-resolution purposes as described in Section 7.

Personal data of Indian users will be stored within India in accordance with applicable data localization requirements. Further detail on data collection, use, and processing is set out in Mapiown’s separate Privacy Policy, which forms part of your agreement with Mapiown.

11. Service Modifications and Availability

Mapiown reserves the right to modify, suspend, or discontinue any feature or service at any time, with or without notice, and without liability to you. Mapiown will endeavor to provide notice of material changes where practicable.

Mapiown does not guarantee uninterrupted or error-free service. The Platform may experience downtime for maintenance, updates, or unforeseen circumstances, and you use the Platform at your own risk.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to Section 4 (Dispute Resolution), any legal action or proceeding shall be subject to the exclusive jurisdiction of the courts in New Delhi, India, and you waive any objection to jurisdiction or venue in such courts.

If any provision of these Terms is found invalid or unenforceable under applicable law, that provision shall be severed and the remaining provisions shall continue in full force and effect.

13. Contact and Notices

For support, complaints, or general inquiries, contact Mapiown at support@Mapiown.com. Legal notices should be sent to the same address or by registered mail to Mapiown’s registered office in New Delhi, India.

    • You agree to receive notices from Mapiown via email, in-app notification, or posting on the Platform. Notices are deemed effective when sent.
    • You are responsible for keeping your contact information current and for any missed notifications resulting from outdated details.
    • All notices must be in writing and in English.

14. General Provisions

    • These Terms, together with Mapiown’s Privacy Policy, constitute the entire agreement between you and Mapiown and supersede all prior agreements or understandings regarding the Platform.
    • These Terms do not create a partnership, joint venture, or employment relationship between you and Mapiown.
    • You may not assign your rights under these Terms without Mapiown’s prior written consent. Mapiown may assign these Terms to another entity, including in connection with a merger, acquisition, or sale of assets.
    • No waiver of any provision or breach shall be deemed a waiver of any other provision or any subsequent breach.
    • Mapiown’s rights and remedies under these Terms are cumulative and not exclusive of any other rights or remedies available at law.
    • Mapiown reserves the right to modify these Terms at any time. Material changes will be notified via email or Platform notice, and continued use of the Platform after such changes constitutes your acceptance of the updated Terms.

By accessing or using the Mapiown Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
