Mentor & Counselor Confidentiality Agreement

This Confidentiality Agreement is entered into between Mapiown and the undersigned individual acting as a Mentor or Counselor on the Mapiown platform . By signing below or accepting this Agreement electronically during onboarding, you agree to be bound by its terms as a condition of joining and continuing to use Mapiown as a Mentor or Counselor.
1. Purpose
Mapiown connects platform Users with Mentors and Counselors for guidance sessions based on career assessment results generated through Mapiown’s SAPIO matching architecture. In the course of providing these services, Mentors and Counselors will have access to Users’ personal information, assessment results, and details shared during one-to-one sessions. This Agreement sets out your obligations to protect that information and to interact with Users solely through the Mapiown platform.
2. Definition of Confidential Information
“Confidential Information” includes, without limitation:
- A User’s name, contact details, age, location, and any other personal information visible on the platform.
- A User’s career assessment responses, personality/interest/value/skills profile, and SAPIO-generated results.
- Anything discussed, disclosed, or shared by a User during a mentoring or counseling session, whether verbal, written, or otherwise.
- Any notes, records, or guidance the Mentor/Counselor creates in connection with a session.
- Any proprietary or business information belonging to Mapiown, including but not limited to information about the SAPIO algorithm, platform features not yet public, and internal processes.
3. No Retrieval or Solicitation of Personal Contact Information
The Mentor/Counselor shall not, under any circumstances, ask, request, solicit, or attempt to retrieve a User’s personal contact information — including but not limited to phone number, personal email address, home address, social media handles, or any other direct contact detail — whether from the User directly, from Mapiown’s systems, or through any other means. This restriction applies regardless of the User’s age, and applies with heightened strictness where the User is a minor. Any such request, however framed, is a material breach of this Agreement and may result in immediate termination from the platform and referral to appropriate authorities where warranted.
4. Platform-Only Communication
All communication, scheduling, and interaction between a Mentor/Counselor and a User must take place exclusively through Mapiown’s platform and its designated tools (including the Google Meet link generated for a scheduled session). The Mentor/Counselor shall not initiate or continue any communication with a User outside of Mapiown — including via personal phone, personal email, social media, messaging apps, or any in-person contact arranged independently of the platform. This obligation continues even if a User requests or initiates off-platform contact; the Mentor/Counselor must decline and redirect the User back to the Mapiown platform.
5. General Confidentiality Obligations
- Use Confidential Information solely for the purpose of providing mentoring or counseling guidance through Mapiown, and for no other purpose.
- Not disclose Confidential Information to any third party, including friends, family, colleagues, or other Users, without the User’s explicit written consent or Mapiown’s prior written approval.
- Take reasonable precautions to protect any notes or records from unauthorized access, including not storing them on personal, unsecured devices outside the platform where avoidable.
- Not use any User’s information, story, or case details — even anonymized — in public materials, social media, publications, or marketing without separate written consent.
- Immediately notify Mapiown at info.mapiown@gmail.com if the Mentor/Counselor becomes aware of any unauthorized disclosure or suspected breach of a User’s Confidential Information.
6. Additional Duties Regarding Minor Users
Mapiown serves Users from age 10, and India’s Digital Personal Data Protection Act 2023 treats anyone under 18 as a child requiring heightened protection. In addition to the obligations above, the Mentor/Counselor agrees to:
- Interact with minor Users in a manner that is age-appropriate, professional, and strictly limited to career guidance.
- Never request, encourage, or accept photographs, personal social media connections, gifts, or any form of contact with a minor User outside the platform.
- Immediately report to Mapiown any disclosure by a minor User that suggests risk of harm, abuse, or exploitation, or any attempt by a minor User to move communication off-platform.
7. Exceptions to Confidentiality
The obligations in this Agreement do not apply where disclosure is:
- Required by law, regulation, or a valid order of a court or government authority.
- Necessary to prevent harm to the User or another person, including suspected abuse, self-harm risk, or threat to safety, in which case the Mentor/Counselor must promptly inform Mapiown and, where appropriate, relevant authorities.
- Made to Mapiown’s own support staff for the purpose of platform operation, safety, or dispute resolution, consistent with Mapiown’s Privacy Policy.
- Information that is or becomes publicly available through no fault of the Mentor/Counselor.
8. Data Handling and Retention
Session notes and records remain the property of Mapiown and are subject to Mapiown’s data retention and deletion practices as set out in the Privacy Policy. Upon a Mentor/Counselor’s account closure, exit from the platform, or at Mapiown’s request, the Mentor/Counselor must cease using and, where instructed, delete any locally held copies of User information, notes, or records not maintained through the platform itself.
9. Duration
This Agreement takes effect upon acceptance and continues for as long as the Mentor/Counselor is registered on Mapiown. The confidentiality obligations in all Sections survive termination of the Mentor/Counselor’s relationship with Mapiown indefinitely with respect to information already received.
10. Consequences of Breach
Any breach of this Agreement — including any attempt to obtain a User’s personal contact information or to communicate with a User outside the Mapiown platform — may result in immediate suspension or termination of the Mentor/Counselor’s account, forfeiture of pending payments, and, where applicable, legal action and reporting to relevant authorities. Mapiown reserves the right to pursue injunctive relief and damages for any breach that causes harm to a User or to Mapiown.
11. Governing Law
This Agreement is governed by the laws of India. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts at [Insert City/State of Registration].
12. Acknowledgement
By accepting this Agreement, the Mentor/Counselor confirms they have read, understood, and agree to be bound by all provisions above, including the restrictions on requesting personal contact information and on communicating with Users outside the Mapiown platform.
